Aid for ADUs
Aid for ADUs is a loan program designed to assist existing homeowners by providing low-cost loans for the construction or conversion of existing spaces into Accessory Dwelling Units (ADUs) where permitted.
Through the Aid For ADUs Program, the Eagle County Housing and Development Authority may offer up to $100,000 in the form of a loan, secured by a Promissory Note and Deed of Trust, to the homeowner. In exchange, the homeowner is required to lease the ADU to an Eligible Household at a monthly rental rate that does not exceed 100% of the Area Median Income (AMI). The program aims to generate new, year-round housing units at attainable rental rates in Eagle County, making them available to renters today.
In Eagle County, ADUs are known by various names, including in-law apartments, secondary suites, garage apartments, and lock-offs, among others. However, for the purposes of this program, an ADU is defined as a separate dwelling unit that is subordinate to the principal use of the property. It must include kitchen facilities (at a minimum, a sink and a stove or oven dedicated to meal preparation), a bathroom (equipped with a toilet, sink, and shower or bathtub), and areas for living and sleeping.
The purpose of an ADU is to independently accommodate individuals separate from the occupants of the main residence, ensuring no reliance on the main residence for essential needs. ADUs can be either within or attached to the main property's structure or completely detached. It is the Owner's responsibility to verify that ADUs are allowed on their property, secure all necessary approvals or permits from the local governing authority, and comply with all applicable rules and regulations, including building codes.
As a condition of the loan, the owner must lease the ADU to an Eligible Household as defined in the Eagle County Affordable Housing Guidelines: Administrative Procedures. Short-term rentals are strictly prohibited.
